In general, the EU DR 2023/1185 does not classify the CO2 into biogenic and non-biogenic, i.e. any source of CO2 can be used to produce RFNBO. However, in order to be considered eligible for emissions from inputs’ existing use or fate (eex-use), CO2 shall meet certain requirements. The full requirements are detailed in ISCC EU 205-1 RFNBO and RCF Greenhouse Gas Emissions, chapter 3.1.1.3, “Emissions from existing use or fate”.
